1. DEFINITIONS
In the following terms and conditions,
- “Program” refers to any service package offered by way of email and consultation with health coach.
- “Client” refers to an Individual or a Firm or a Company who enrolls for Programs(s) provided by the “Health coach”.
- “Program Duration” refers to the specific time period for which the “Program” is valid.
- “Program Fees” refers to the fees charged by the “Health coach” to render services in the “Program”.
- “Associates” refers to any employee(s) of Health coach and/or Independent Contractor(s) and/or Service Provider(s) contracted by Health coach
2. PURPOSE
- These terms and conditions (“Terms”) shall govern the transaction between Health coach and the Client.
- The Client acknowledges that Health coach may engage other parties, namely its employees and/or third parties including Independent Contractors and Service Partners for the fulfilment of the Program as its Associates and the Client hereby consents to Health coach disclosing, to the extent relevant, the Client’s Personal Information and/or details of Program (s) availed by the Client to such Associates.
- The Client acknowledges the receipt of the Terms and the Program(s) Terms, as applicable and agrees to be fully bound by the Terms and the relevant Program Terms.
3. FEES REFUND AND CANCELLATION POLICY
- Health coach shall charge the Client, Program Fees as detailed in the Program Terms.
- The Program Fee shall be payable in advance for the full Program Duration.
- Activation of the Program(s) is subject to realization/receipt of the Program Fee.
- The Program is non-transferable to another party.
- All Payments made to the program are non-refundable and non-transferable. Health coach shall not be under any obligation to refund any fee, on any ground. including on humanitarian ground, if so claimed, on account of any injury or death caused to the Client.
- Any applicable refund due to payment gateway failure or chargeback will be subject to the terms and conditions of the respective payment gateway/UPI.
- Program Subscriptions once made / placed, cannot be cancelled for any reason. There shall be no refunds.
4. OBLIGATION AND CONVENANTS OF THE CLIENT
- The Client acknowledges that the advice provided under the Program Term by Health coach and its Associates is solely intended for the Client and cannot be used for any other individual(s).
- The Client acknowledges to provide complete and accurate information to Health coach and its Associates as required for fulfilment of services under the Program Terms.
- The Client needs to inform Health coach before the program begins if the Client wants to delay the start date of the program.
- Once the program begins the Client is allowed to put the program on hold only once during the tenure of the Program for a maximum period of two weeks.
5. PERSONAL RESPONSIBILITY AND RELEASE OF HEALTH CARE RELATED CLAIMS
The client acknowledges that the client takes full responsibility for the client’s life and well-being and all decisions made during and after this program.
The client expressly assumes the risks of the program, including the risks of trying new foods or supplements, and the risks inherent in making lifestyle changes.
The client releases the coach, Plera Wellness Plus and their employees from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the client ever had, now has or will have in the future against the coach, arising from the client’s past or future participation in, or otherwise with respect to, the program, unless arising from the gross negligence of the coach.
6. CONFIDENTIALITY
Health coach shall make reasonable efforts to ensure that the Personal Information of the Client is kept confidential and not disclosed to any third party except to the extent required for fulfilment of services.
7. MISCELLANEOUS & DISCLAIMERS
The Agreement shall be governed by the laws of the Republic of India and only the courts of Mumbai shall have jurisdiction to entertain disputes under this Agreement.
Health coach reserves the right to amend the Terms and/or the Program Terms and/or the features or pricing of the Programs. Upon such amendment such terms will become applicable immediately and will be intimated to the Client in due course. If the Client does not accept the amendment of the Terms and/or the Program Terms, he shall have the right to terminate the Terms and the Program Terms.
The client understands that the role of the Health Coach is not to prescribe or assess micro- and macronutrient levels; provide medical or other therapy services; or to diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body.
Rather, the coach is a mentor and guide who has been trained in holistic health coaching to help clients reach their own health goals by helping clients devise and implement positive, sustainable lifestyle changes.
The client understands that the coach is not acting in the capacity of a doctor, licensed dietician-nutritionist, psychologist and that any advice given by the coach is not meant to take the place of advice by these professionals.
If the client is under the care of a health care professional or currently uses prescription medications, the client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor.
The client has chosen to work with the coach and understands that the information received should not be seen as medical or nursing advice and is not meant to take the place of seeing licensed health professionals.
8. PRICING
Pricing will be based on services which opt by the customer.
